1. Prosecutions:
1.1 St Albans Magistrates Court.
On Monday 04 October 2004, Carillion Construction Ltd appeared before St Albans Magistrates' Court.
The HSE case followed their investigation into the collapse, in September 2002, of some temporary scaffold being used on the University of Hertfordshire construction site. Three non-Carillion bricklayers were working on the scaffold at the time of the collapse, and one person fell approx. 6.5m sustaining semi-permanent back injuries.
There were two other co-defendants: “Interserve” who erected the scaffold, and “Swifts” who engaged the bricklayers.
Each of the three parties pleaded guilty to a single breach of Section 3(1) of the HSW Act 1974, i.e. failure to ensure, so far as was reasonably practicable, the safety of persons not in their employment.
The Magistrates accepted jurisdiction and Carillion was fined £20000, plus £6460 costs.

Issued on 22/06/04 due to risk of falls from height and unsafe system of work on asbestos cement roof.
Breaches of HSW Act 1974 Ss 2 and 3 and Construction (Health, Safety and Welfare) Regulations 1996, Rgs 6 and 7.
2.2 Prohibition notice – Immediate [F230007581] Wolverhampton.
Issued on 16/06/04 for failing to implement an adequate workplace transport plan that could deal with the loading and offloading of materials and the movement of plant at their site on Albion Street Wolverhampton.
Breaches of HSW Act 1974 Ss 2 and 3 and Construction (Health, Safety and Welfare) Regulations 1996, Rg 4.
2.3 Improvement notice [R220000330]
Issued on 15/04/04 for appointed persons engaged in buried service location techniques are inadequately selected, trained, examined, appointed and subsequently periodically assessed so as to be and remain competent.
